These Terms of Service ("Terms") govern your access to and use of our website, as well as any booking, scheduling, purchasing, or consultation of our residential and commercial HVAC, plumbing, electrical, and maintenance services.

By accessing our Site or booking a service with us, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use this Site or engage our services.

1. Services Offered & Eligibility

• Eligibility: You must be at least 18 years old and have the legal authority to enter into a binding agreement to use this Site or book our services.
• Service Area: Our services are generally available in Fredericton, Moncton, and surrounding areas in New Brunswick. We reserve the right to limit the provision of our services to any person, geographic region, or jurisdiction.

2. Service Bookings, Quotes, and Estimates

• Requesting a Quote: Any estimates or quotes provided via online contact forms or over the phone are preliminary. Binding contract pricing is only established after an on-site evaluation by an authorized E.T. Mechanical technician and the signing of a formal work order.
• Quote Validity: Written quotes and estimates are valid for 30 days from the date issued, unless specified otherwise in writing.
• Rescheduling and Cancellations: We request at least 24 hours' notice for the cancellation or rescheduling of any standard service call. Emergency calls or high-demand seasonal installations may be subject to specific cancellation conditions outlined at the time of booking.

3. Customer Responsibilities

To ensure the safety of our technicians and the efficient completion of work, you agree to:

• Ensure an adult (18 years or older) with the authority to approve work and payment is present at the property for the duration of the service call.
• Provide clear, unobstructed, and safe access to all relevant equipment, crawl spaces, attics, basements, and outdoor units.
• Secure all pets and ensure a safe, non-hazardous working environment for our staff.
• Obtain any necessary landlord, condo board, or neighborhood approvals required for the installation or alteration of equipment on your property.

4. Pricing, Payments, and Billing

• Payment Due Date: Payment for diagnostic fees, standard service calls, and small repairs is due immediately upon completion of the work, unless alternative credit terms have been formally agreed upon in writing.
• Deposits: Major equipment installations (such as heat pumps, furnaces, or extensive electrical panel upgrades) may require a down payment or deposit prior to ordering equipment and scheduling the installation.
• Comfort Club Memberships: Membership fees are automatically billed on a monthly or annual recurring basis depending on the plan selected. You authorize E.T. Mechanical Ltd. to charge your designated payment method for these recurring fees until you cancel your membership in accordance with the Comfort Club terms.
• Late Payments: Late payments may be subject to interest charges calculated at the maximum rate permitted by provincial law.

5. Warranties and Guarantees

• Manufacturer Warranties: New equipment installations (e.g., heat pumps, mini-splits, furnaces) are backed by specific manufacturer warranties. E.T. Mechanical Ltd. will assist you in registering and navigating these warranties, but the manufacturer remains solely responsible for the terms of their product warranty.
• Labor Warranty: E.T. Mechanical Ltd. stands behind the quality of our craftsmanship. All labor performed by our technicians comes with a limited warranty, the duration of which will be explicitly detailed on your final invoice or work order.
• Exclusions: Warranties do not cover damage caused by lack of regular maintenance (such as dirty filters), customer negligence, standard wear and tear, acts of God (floods, lightning strikes, severe storms), or unauthorized third-party tampering with the system.

6. Limitation of Liability

To the maximum extent permitted by applicable law, E.T. Mechanical Ltd., its directors, employees, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, property damage due to existing structural or plumbing vulnerabilities, or system downtime, arising out of or related to your use of this Site or our physical services.

Our total cumulative liability for any claim arising from our services shall not exceed the total amount paid by you to E.T. Mechanical Ltd. for the specific service call or installation giving rise to the claim.

7. Intellectual Property

All content on this Site—including text, graphics, logos, images, digital downloads, and code—is the property of E.T. Mechanical Ltd. or its content suppliers and is protected by Canadian and international copyright laws. You may not copy, reproduce, or distribute any content from this Site without explicit written permission from us.

8. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by, interpreted, and enforced in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein.
